Seller Agreement

In addition to the Definitions and Agreements found here, your Use of this Subscription Service from Diecast Customs LLC, you constitute your understanding and consent with the following terms:

You authorize Diecast Customs LLC to charge or debit your indicated payment method each month in the amount designated in the payment plan setup process. You agree that your specified payment method is, and will continue to be, an account that you own, and that you will maintain sufficient credit or availability to maintain your subscription fees until cancellation. You may cancel your subscription at any time. Users will lose their subscription service for nonpayment. The Free Subscriber fees will automatically apply to any orders after nonpayment occurs related to a PRO subscriber account which may result in higher transaction fees. Charges will begin upon subscription purchase and will recur on the same day of the month each month until cancellation. These agreements constitute your copy of your recurring payment authorization to Diecast Customs LLC. Please print and retain a copy of this recurring payment authorization for your records.

These terms are subject to change with or without notice.

Items sold must include tracking numbers within five (5) business days or the sale may be cancelled. If a sale is cancelled the Seller will incur a $1 cancellation fee.

Each User that registered as a subscribed Seller is treated as a non-collecting seller. This means that you, the Seller, are not collecting and remitting sales tax to U.S. states where your customers live. Subsequently, use taxes may be due to your applicable customers that live in certain states.

Each User that is registered as a subscribed Seller may have personal or business obligations to report income tax to their state, federal government, or other taxing authority. Diecast Customs LLC uses Stripe as its payment processor, and Stripe will issue an IRS Form 1099-K to any Seller whose account is based in the United States and “received gross payments that exceed $20,000 and [had] more than 200 such transactions,” in the prior calendar year and is registered as self-employed or as a business. It is the complete and sole responsibility of each User to comply with their relevant tax and reporting laws and mandates.

Each User registered as a subscribed Seller and lives in a country supported by the payment processor Stripe must register an account with Stripe in order to collect payouts. Users outside of countries supported by Stripe must select PayPal as their payout option in their seller dashboard after subscribing.

Pursuant to the Terms of Service, Diecast Customs LLC is no party in any agreement between Sellers and Customers, and that we do not control the conduct of any Users of the Website. Diecast Customs LLC disclaims all liability in this regard to the fullest extent permitted by the law. Diecast Customs does offer a service to handle disputes raised by customers against Sellers. Your Use of this Website, in addition to your voluntary subscriber status, indicates your understanding and consent to the Cancellations, Disputes, and Return Policies found here.

As a part of the Subscription Service offered to Sellers, Diecast Customs LLC provides a platform for streamlined sales of goods and services. As a part of that Service, we require all Users to consent to all relevant Agreements (located here), which includes a standard of conduct as well as the Returns, Dispute, and Refund Policy. 

Free Subscriptions may sell completed diecast customs creations only; if a Free Subscriber abuses the selling feature by uploading any other products for sale then their account is subject to suspension or deletion. Selling other products and services is available to PRO subscribers only. 

Acceptable products and services to sell on www.diecastcustoms.com for PRO Subscribers only: stock diecast models, diecast custom toys, parts and accessories relevant to diecast customs, merchandise promoting your brand or identity, digital products, goods or services relevant to diecast customs, items that do not infringe copyright protections, threaten, or intend to do harm to another person or User, cause risk for injury or death of any person or User or any other use that may disrupt legal compliance and the good reputation of Diecast Customs LLC. We reserve the right to remove content from our Website without notice and at any time. 

It is important to categorize your products and services correctly to preserve the integrity of the Diecast Customs LLC database. By agreeing to these terms, you consent to categorize your products and services to the best of your knowledge. Diecast Customs LLC reserves the right to re-categorize products to preserve the integrity of the database.
